Publication requirement

Georgia requires newspaper publication after formation. Corporations must publish a notice of intent to incorporate in the county legal organ (or a qualifying newspaper) where the registered office is located; the notice and payment must be sent to the newspaper by the next business day after filing. LLCs have no publication requirement. Current SOS procedure (Rev. 9/2025) no longer states a fixed fee; the prior version (Rev. 11/2024) gave $40.

Worth knowing

  • LLC and corporation formation both cost $110 ($100 + $10 service charge), online or paper.
  • Annual registration ($60, nonprofits $40) is due January 1 - April 1; up to 3 years can be prepaid.
  • Corporations (not LLCs) must publish a notice of incorporation in the county legal newspaper.
  • New corporations must file their first annual registration within 90 days of incorporating.

Registered agent

Georgia requires a registered agent. Must continuously maintain a registered agent and registered office with a Georgia street address (no P.O. box). You can serve as your own agent if you have a qualifying address; paid services usually charge a yearly fee.
